By approving a proposal, submitting payment, or allowing installation of permanent lighting by Athens Christmas Lights (“Athens Christmas Lights,” “Company,” “we,” “us,” or “our”), you (“Client,” “you,” or “your”) agree to the following Terms of Service.
1. Introduction
Athens Christmas Lights offers professionally installed permanent architectural lighting systems for residential and commercial properties. All installations and service work are performed to high industry standards using quality materials and proven installation methods. Our goal is to provide workmanship and products that meet or exceed permanent lighting standards within the marketplace.
2. Services
2.1 Athens Christmas Lights specializes in the design, installation, servicing, and support of permanent exterior lighting systems.
2.2 Services may include installation, diagnostics, warranty coordination, maintenance, and repairs. Permanent lighting systems are not designed for seasonal removal.
3. Eligibility & Term of Agreement
3.1 By accepting these terms, you confirm that you are at least 18 years old and legally authorized to enter into a binding agreement.
3.2 This agreement becomes effective upon acceptance of a proposal or payment and remains in effect for the lifespan of the installed system unless terminated under these terms.
4. Payment Terms
4.1 The client agrees to pay all fees outlined in the approved proposal or invoice.
4.2 Payment terms, including deposits, final payment, and accepted payment methods, are specified in the invoice provided.
4.3 Athens Christmas Lights reserves the right to suspend work, withhold activation, or delay service if payment obligations are not met.
5. Access & Safety
5.1 The client is responsible for providing safe and reasonable access to the property, including electrical access and clear work areas.
5.2 Athens Christmas Lights reserves the right to refuse or stop work if conditions are deemed unsafe for technicians, property, or equipment.
6. Cancellation & Refund Policy
6.1 Cancellations must be submitted in writing at least 15 business days prior to the scheduled installation date.
6.2 Refunds are not guaranteed and are reviewed on a case-by-case basis.
6.3 Once permanent lighting materials or products have been ordered, any approved cancellation will be subject to a 25% restocking fee.
No exceptions.
Permanent lighting systems installed by Athens Christmas Lights utilize products supplied by LightsAtWholesale.com, which include a 5-year limited manufacturer warranty on LED lighting components and fixtures.
The manufacturer warranty covers:
Defects in materials and workmanship under normal use
The manufacturer warranty does not cover:
Improper use, misuse, or abuse
Unauthorized modifications or alterations
Damage caused by power surges, voltage irregularities, or electrical supply issues
Acts of God, including storms, lightning, wind, hail, flooding, or fire
Damage caused by third parties, animals, or landscaping equipment
Manufacturer warranties are limited to replacement of defective components only and do not automatically include labor.
8. Labor Warranty & Service Fees
8.1 Athens Christmas Lights provides a 1-year labor warranty covering installation workmanship.
8.2 After the labor warranty period expires, service visits are subject to a $75 trip fee for the first hour and $75 per hour thereafter.
8.3 Warranty claims must involve verified product malfunction. Labor, access, and reinstallation costs may apply outside the labor warranty period.
9. Maintenance & Repairs
9.1 The client agrees to promptly report any system issues to Athens Christmas Lights to allow timely service.
9.2 Failure to report issues in a timely manner may result in additional damage not covered under warranty.
9.3 Athens Christmas Lights is not responsible for damage caused by neglect, unauthorized repairs, or modifications made by anyone other than Athens Christmas Lights.
10.1 The client is responsible for providing a properly functioning electrical supply, including GFCI outlets where required.
10.2 Athens Christmas Lights is not responsible for tripped breakers, GFCI interruptions, or existing electrical deficiencies.
11.1 Athens Christmas Lights is not liable for indirect, incidental, or consequential damages arising from the use or operation of the installed lighting system.
11.2 While reasonable care is taken during installation, Athens Christmas Lights is not responsible for pre-existing conditions or normal wear to roofing, siding, trim, landscaping, or electrical systems.
The client agrees to indemnify and hold harmless Athens Christmas Lights, its owners, employees, and contractors from any claims, damages, or expenses arising from the use, operation, or presence of the installed lighting system after installation is complete.
13.1 Either party may terminate this agreement with written notice if the other party materially breaches these terms and fails to cure the breach within a reasonable time.
14. Governing Law
14.1 This agreement shall be governed by and interpreted in accordance with the laws of the State of Georgia.
15. Changes to Terms
15.1 Athens Christmas Lights reserves the right to update or modify these Terms of Service at any time.
15.2 Updated terms will be communicated via email, text message, phone call, or posted on our website.
